1. Agreement to Terms

These Terms of Service govern your use of the Only Snoots website and services. By accessing our website, creating an account, or placing an order, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.

We recommend that you print a copy of these terms for future reference.

2. Eligibility

By using our services, you confirm that:

• You are at least 16 years old
• You have the legal capacity to enter into a binding contract
• You are not prohibited from receiving our services under applicable laws

3. Account Registration

To access certain features of our services, you may need to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorised access or security breach
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if you violate these terms or if we suspect fraudulent activity.

4. Products and Services

4.1 Physical Cards

We sell customised printed greeting cards. By placing an order, you understand that:

• Cards are personalised to your specifications (photos, text, designs)
• We use third-party print fulfillment services
• Colours may vary slightly from screen to print
• You are responsible for ensuring your customisations are accurate

4.2 Digital Cards (Ecards)

We offer free digital cards sent via email. By using this service:

• You must provide a valid recipient email address
• We do not guarantee delivery to email addresses that reject our emails
• Ecards are delivered immediately and cannot be recalled
• You must verify your email before sending ecards (anti-spam measure)

5. Orders and Payment

By placing an order, you confirm that:

• All information provided is accurate and complete
• You are authorised to use the payment method provided
• You authorise us to charge the applicable fees to your payment method
• Prices are in GBP (£) and include VAT where applicable

We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, errors in pricing or product descriptions, or suspected fraud.

Payment Processing

All payments are processed securely through Stripe. We do not store your full credit card details. Payment information is encrypted and processed in accordance with PCI DSS standards.

6. Shipping and Delivery

We use third-party fulfillment services to print and ship your orders. Delivery times are estimates and not guaranteed:

• Royal Mail First Class: 1-2 business days
• Royal Mail Second Class: 3-5 business days

Risk of loss and title for items pass to you upon delivery to the carrier. We are not responsible for delays caused by postal services or customs. You are responsible for providing an accurate delivery address.

7. Cancellation and Refunds

7.1 Customised Physical Cards

Under the Consumer Rights Act 2015, the 14-day cooling-off period does not apply to personalised goods that are made to your specifications. Since our printed cards are customised with your photos, text, and designs, you do not have the right to cancel once production has begun.

However, we offer a 1-hour grace period after placing your order during which you may cancel and receive a full refund. After this period, the order cannot be cancelled as production will have begun.

7.2 Non-Customised Products

For standard (non-customised) products, you have the right to cancel your order within 14 days of receipt for a full refund, provided the items are unused and in their original condition.

7.3 Digital Cards (Ecards)

Digital cards are delivered immediately upon sending and cannot be cancelled or refunded once sent. This is because digital content is supplied immediately and the performance begins before the end of the cancellation period.

7.4 Damaged or Defective Items

If you receive a damaged or defective item, please contact us within 14 days of delivery with photos of the damage. We will either replace the item or issue a full refund at our discretion.

8. User Content

You may upload photos and add text to personalise cards. This content is used only to create your specific order (printed card or ecard) and is not displayed publicly on our website or shared with other users.

By submitting content:

• You grant us a limited licence to use the content solely to fulfill your specific order
• You confirm you own the rights to the content or have permission to use it
• You confirm you have obtained consent from any individuals depicted in photos (where required)
• You will not upload content that is illegal, offensive, defamatory, hateful, sexually explicit, or infringes others' rights
• You will not upload content containing malware, viruses, or other harmful code
• You will not upload content that promotes violence, discrimination, or illegal activities

We use AI content moderation to review all uploads. We reserve the right to refuse any order containing inappropriate content without refund if the content violates these terms. Repeated violations may result in account suspension.

We do not claim ownership of your uploaded content. However, by uploading you grant us the rights necessary to: (a) display the content to you in the card editor, (b) print the content on physical cards, (c) embed the content in digital ecards sent to your specified recipient, and (d) store the content temporarily to fulfill your order.

9. Intellectual Property

All content on Only Snoots, including designs, logos, text, graphics, and artwork, is the property of Only Snoots or our licensed artists and is protected by UK and international copyright laws.

You may not:

• Reproduce, distribute, or publicly display our content without permission
• Create derivative works from our designs
• Use our trademarks without written consent
• Scrape or systematically collect data from our website

When you purchase a card, you receive a license to use that specific physical card. You do not acquire any intellectual property rights in the designs.

10. Prohibited Activities

You agree not to:

• Use our services for any unlawful purpose
• Upload viruses, malware, or other harmful code
• Attempt to gain unauthorised access to our systems
• Interfere with the proper working of our website
• Collect user information without consent
• Use automated systems to access our website
• Impersonate any person or misrepresent your affiliation
• Engage in fraudulent activities or payment abuse

11. Limitation of Liability

To the extent permitted by law:

• We provide our services "as is" and "as available" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the specific product or service in question
• We are not responsible for third-party services (Stripe, Royal Mail)

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Only Snoots, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these terms, or your infringement of any third-party rights.

13. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, riots, embargoes, strikes, government actions, or failures of third-party services.

14. Changes to Terms

We may revise these terms at any time. Changes will be effective immediately upon posting to this page with an updated "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the revised terms.

For significant changes, we will notify you via email or through a notice on our website.

15. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. This does not affect your rights as a consumer under mandatory provisions of UK law.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
